IS THCA LEGAL
IN EUROPE?

The honest answer: it depends. On the country, and on what the product is for. Here is a clear country by country guide for 2026, and where collection flowers not intended for consumption fit into the picture.

2026 Overview

THCA in Europe: It Depends

There is no single European answer. The status of THCA changes from one country to another, and it also changes with the use. The same flower can be looked at very differently depending on whether it is a consumer product or a collector item kept for display.

Open permissive framework Depends on use consumer rules apply, collection differs

At Green Connection we sell collection flowers, presented as display and collector items and not intended for consumption. That positioning is what shapes everything on this page.

The Basics

What Is THCA?

THCA stands for tetrahydrocannabinolic acid. It is the raw, acidic form found in the fresh cannabis plant, and it comes from CBGA, often called the mother of all cannabinoids.

THCA · C₂₂H₃₀O₄

In its raw, acidic state THCA carries a carboxyl group (COOH). THCA is the precursor that can convert into THC, and that conversion potential is the key fact behind almost every legal decision in Europe.

The Real Answer

Two Questions Decide Everything

Whenever someone asks if THCA is legal, the honest reply is another two questions. Get these right and the whole map makes sense.

1. Which country?

Every country sets its own rules. Some, like Czechia, are very open. Others regulate the consumer market more tightly. Our country guide below shows exactly where each one stands in 2026.

2. What is it for?

Most frameworks treat a product made for consumption very differently from an item kept as a collectible. A flower sold as a collector piece, not for consumption, sits in a different conversation entirely.

This is the heart of it. Green Connection flowers are collection items, not intended for consumption. We are clear about that, and we ask every collector to respect the rules that apply where they live.

Comparison

THCA vs THC vs CBD

These three are often mixed up. Here is the difference that matters.

CBD has clear protection across the EU thanks to the 2020 Kanavape ruling. If you want a product that travels easily, CBD is the simplest route, and we carry a full CBD range too.

The Key Concept

The Total THC Rule

Many people assume that a product showing less than 0.3% Delta 9 THC in a lab test is automatically fine. For THCA, that is the most common misunderstanding.

Total THC = Delta 9 THC + (0.877 × THCA)

A real Green Connection certificate of analysis. Total THC is calculated as Delta 9 plus 0.877 times THCA.

Most European authorities do not only read the Delta 9 THC. They calculate total THC, which adds the THC that the THCA could become. The factor 0.877 reflects the weight difference between the two molecules. The result: a flower with a tiny Delta 9 figure but rich in THCA can still sit above the consumer limit once total THC is calculated.

In plain words. The 0.3% rule works well for CBD, because CBD does not turn into THC. It does not protect THCA in the same way. That single difference explains why THCA is treated so differently across Europe, and why the collection positioning matters.

Country Guide

THCA Country by Country (2026)

Where each main European market stands in 2026. The status shown reflects the consumer market. Collection items not intended for consumption are a separate matter, and we ask collectors to always check the rules where they live.

CountryStatusWhat to know
🇨🇿 CzechiaOpenOne of the most open frameworks in Europe. Testing focuses on Delta 9 with generous thresholds. A natural home for collectors.
🇨🇭 SwitzerlandOpenOutside the EU, with a relatively open and evolving framework. Popular with European collectors. Customs differ from the EU.
🇵🇹 PortugalDepends on usePersonal possession is decriminalised. Consumer rules are stricter, so the collection positioning matters here.
🇬🇧 United KingdomDepends on useTHCA is not named in the law. Anything tied to consumption is read under THC rules, so collectors keep items as display pieces, not for use.
🇫🇷 FranceDepends on useConsumer products are measured on total THC. Items kept as collectibles, not for consumption, sit in a different conversation. Check local rules.
🇩🇪 GermanyDepends on useTotal THC applies to consumer goods. Collection and technical positioning is handled separately. Verify locally.
🇦🇹 AustriaDepends on useThe consumer market runs on total THC. Non consumption collection items are a distinct category.
🇮🇹 ItalyDepends on useRules tightened in 2025 for consumer hemp flower. Collection framing is the cautious route here.
🇳🇱 NetherlandsDepends on useKnown for its tolerance, but the consumer Delta 9 limit is very low. Collection positioning is the careful approach.
🇪🇸 SpainDepends on useSpain is the strictest on this list. THCA is named in its controlled list, so anything linked to consumption is tightly regulated. Treat strictly as non consumption collection and check local rules.

The pattern is simple. The most open markets test Delta 9 alone with generous limits. The strictest name THCA directly. Everywhere in between, the use is what counts, which is why we sell strictly as collection, not for consumption.

In Detail

THCA by Country: The Detail

A closer look at the markets people search for most. In every case the same rule applies: the use is what counts, and our flowers are collection items, not intended for consumption.

🇩🇪 Is THCA legal in Germany?

Germany is one of the largest markets in Europe and calculates total THC for consumer goods, which keeps THCA rich consumer products tightly regulated. Germany opened up to adult cannabis use in 2024, but hemp product sales follow their own rules. Items presented as collectibles, not intended for consumption, sit in a separate category. Always check the current local position.

🇫🇷 Is THCA legal in France?

France measures consumer hemp products on total THC against a 0.3% ceiling, so any meaningful THCA content pushes a consumer product over the line. The collection angle, where the item is kept for display and not intended for consumption, is a different conversation. Verify the rules that apply where you are.

🇪🇸 Is THCA legal in Spain?

Spain is the strictest market on this list, because THCA is named directly in its controlled list. Anything tied to consumption is tightly regulated. We ask Spanish collectors to treat any item strictly as a non consumption collectible and to check their local rules carefully.

🇮🇹 Is THCA legal in Italy?

Italy tightened the rules around consumer hemp flower in 2025. For collectors, the cautious and clean route is a strict collection positioning, not intended for consumption, alongside a check of the latest national guidance.

🇬🇧 Is THCA legal in United Kingdom?

THCA is not named in UK law, but anything connected to consumption is read under THC rules. UK collectors keep items as display pieces only. The legal position is evolving, so it is worth checking the most recent guidance before ordering.

🇨🇿 Is THCA legal in Czechia?

Czechia applies one of the most open frameworks in Europe, with testing focused on Delta 9 and generous thresholds. The country moved toward broader cannabis reform in 2026. This makes it one of the friendliest homes for European collectors.

🇳🇱 Is THCA legal in Netherlands?

The Netherlands is famous for its tolerant approach, yet its consumer Delta 9 limit is unusually low, so THCA rich consumer goods rarely qualify. The collection positioning is the careful approach for Dutch collectors.

🇨🇭 Is THCA legal in Switzerland?

Switzerland sits outside the EU and runs a relatively open and evolving framework, with some products allowing higher THC than the EU. It is popular with collectors, though customs and rules differ from the EU, so plan accordingly.

The EU Layer

The Europe Wide Rules

On top of national laws, three EU level points shape the whole picture.

Hemp threshold

Since 2023, EU hemp cultivation allows up to 0.3% Delta 9 THC, raised from 0.2%. For food, the maximum is calculated as total THC, using the Delta 9 plus 0.877 times THCA formula.

Novel Food

Ingestible cannabinoid extracts fall under the Novel Food framework. This is a separate layer from the THC rules and is one more reason the collection positioning is the clean one.

The Kanavape ruling

The 2020 Court of Justice ruling protects CBD lawfully produced in one member state. This protection covers CBD, which is why our CBD range is the easiest to move across borders.
